1. WHAT INFORMATION DO WE COLLECT?
Personal information you disclose to us
In Short: We collect personal information that you provide to us.
We collect personal information that you voluntarily provide to us when you express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, when you engage us for coaching, or otherwise when you contact us.
Personal Information Provided by You. The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use. The personal information we collect may include the following:
- names
- phone numbers
- email addresses
- contact preferences
- where you engage us for coaching, further information provided through our client intake form, including your date of birth, address, occupation, marital status, GP name, GP surgery address, GP surgery phone number, and emergency contact name, relationship, and phone number
- where you engage us for coaching, health and mental health information (see Section 4 below)
All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.
Information automatically collected
In Short: Some information — such as your Internet Protocol (IP) address and/or browser and device characteristics — is collected automatically when you visit our Services.
We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, and other technical information.

2. HOW DO WE PROCESS YOUR INFORMATION?
In Short: We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent.
We process your personal information for a variety of reasons, depending on how you interact with our Services, including:
- To deliver and facilitate delivery of services to the user. We may process your information to provide you with the requested service, including coaching services.
- To respond to user inquiries/offer support to users.
- To send administrative information to you.
- To fulfil and manage your orders.
- To identify usage trends.
- To determine the effectiveness of our marketing and promotional campaigns.
- To feature client testimonials, with your separate consent. If you agree, we may process your name, image, and/or testimonial for marketing purposes, including on our website and social media. This is entirely optional, is not a condition of receiving coaching, and is given separately from your consent to the processing of health information described in Section 4. You can withdraw this consent at any time.
- To save or protect an individual's vital interest. We may process your information when necessary to save or protect an individual's vital interest, such as to prevent harm.
3. WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR INFORMATION?
In Short: We only process your personal information when we believe it is necessary and we have a valid legal reason (i.e. legal basis) to do so under applicable law, like with your consent, to comply with laws, to provide you with services to enter into or fulfil our contractual obligations, to protect your rights, or to fulfil our legitimate business interests.
If you are located in the EU or UK, this section applies to you.
The General Data Protection Regulation (GDPR) and UK GDPR require us to explain the valid legal bases we rely on in order to process your personal information. As such, we may rely on the following legal bases:
- Consent. We may process your information if you have given us permission to use your personal information for a specific purpose. You can withdraw your consent at any time.
- Consent for marketing use of testimonials. Where you have separately agreed to let us use your name, image, or testimonial for marketing purposes, we rely on your consent as the legal basis for that specific use. This is distinct from, and does not affect, the explicit consent described in Section 4 for health information.
- Explicit Consent. Where you provide special category (sensitive) data, such as health or mental health information, we rely on your explicit consent as the legal basis, in line with Article 9(2)(a) of the UK GDPR and, where you are located in the EEA, the equivalent provision of the EU GDPR. See Section 4 below.
- Performance of a Contract. We may process your personal information when we believe it is necessary to fulfil our contractual obligations to you, including providing coaching Services.
- Legitimate Interests. We may process your information when we believe it is reasonably necessary to achieve our legitimate business interests.
- Legal Obligations. We may process your information where we believe it is necessary for compliance with our legal obligations, such as to cooperate with a law enforcement body or regulatory agency, exercise or defend our legal rights, or disclose your information as evidence in litigation in which we are involved.
- Vital Interests. We may process your information where we believe it is necessary to protect your vital interests or the vital interests of a third party, such as situations involving potential threats to the safety of any person.
4. SPECIAL CATEGORY DATA COLLECTED THROUGH COACHING INTAKE
In Short: If you engage us for coaching services, we may ask you to provide health and mental health related information on an intake form. We only process this with your explicit consent, and only for the purpose of coaching.
Where you engage Omirakai Consulting for coaching services, we may ask you to complete an intake form that includes health, mental health, and related lifestyle information ("special category data" under UK GDPR Article 9). We collect this information solely to assess your suitability for coaching and to tailor sessions safely.
Legal basis: We process this information on the basis of your explicit consent (Article 9(2)(a) UK GDPR, and the equivalent provision of the EU GDPR where you are located in the EEA), given by signing the relevant consent section of the intake form. You may withdraw this consent at any time by contacting us, though this may affect our ability to continue providing coaching services.
Retention: We retain this information only for as long as necessary for the coaching relationship, after which it is securely deleted, unless a longer retention period is required by law.
Your rights: As with all personal information described in this notice, you may request access to, correction of, or deletion of this information at any time — see Section 10 below for how to exercise these rights.
5. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?
In Short: We may share information in specific situations described in this section and/or with the following third parties.
We may need to share your personal information in the following situations:
- Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
- Your GP or emergency contact, where necessary for your safety. If you provide us with a GP surgery phone number and/or an emergency contact on our client intake form, we may contact them where we reasonably believe it is necessary to protect your safety or the safety of another person — for example, in a health or safety emergency arising during coaching. We will only do this where necessary and proportionate to the circumstances.
6. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

7. HOW LONG DO WE KEEP YOUR INFORMATION?
In Short: We keep your information for as long as necessary to fulfil the purposes outlined in this privacy notice unless otherwise required by law.
We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy notice, unless a longer retention period is required or permitted by law. Health and mental health information collected via coaching intake is retained only for as long as necessary for the coaching relationship (see Section 4).
8. HOW DO WE KEEP YOUR INFORMATION SAFE?
In Short: We aim to protect your personal information through a system of organisational and technical security measures.
We have implemented appropriate and reasonable technical and organisational security measures designed to protect the security of any personal information we process. However, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure.
International data transfers
In Short: Some of our service providers are based outside the UK, including in the United States. Where this is the case, we ensure appropriate safeguards are in place.
Some of the third-party service providers we use to operate our Website and Services (including Hotjar, YouTube/Google, Showtime Analytics, and Elfsight) are based in, or process personal information in, the United States. Where we or our service providers transfer your personal information outside the UK or European Economic Area, we ensure appropriate safeguards are in place, such as Standard Contractual Clauses, the UK International Data Transfer Agreement, or a provider's certification under the UK Extension to the EU-US Data Privacy Framework, so that your information continues to receive an equivalent level of protection.
9. DO WE COLLECT INFORMATION FROM MINORS?
In Short: We do not knowingly collect data from or market to children under 18 years of age, except where a parent or guardian has provided consent on the minor's behalf — for example, through our coaching intake process.
By using the Services, you represent that you are at least 18, or that you are the parent or guardian of a minor client and have provided consent on their behalf, including by signing the relevant sections of our client intake form.
10. WHAT ARE YOUR PRIVACY RIGHTS?
In Short: In some regions, such as the European Economic Area (EEA), United Kingdom (UK), and Canada, you have rights that allow you greater access to and control over your personal information.
In some regions you have certain rights under applicable data protection laws, including the right to request access and obtain a copy of your personal information, to request rectification or erasure, to restrict processing, and, if applicable, to data portability. You can make such a request by contacting us using the details in Section 14 below.
If you are located in the EEA or UK and you believe we are unlawfully processing your personal information, you also have the right to complain to your local data protection supervisory authority.
If you are located outside the EEA, UK, or Canada, you may have similar rights under the data protection or privacy law of your own country. We will honour requests to access, correct, or delete your personal information consistently with this notice regardless of where you are located, to the extent required or permitted by applicable law.
Withdrawing your consent: If we are relying on your consent (including explicit consent for special category data described in Section 4, or consent for marketing use of testimonials described in Sections 2 and 3), you have the right to withdraw it at any time by contacting us using the details in Section 14.
11. CONTROLS FOR DO-NOT-TRACK FEATURES
Most web browsers include a Do-Not-Track ("DNT") feature. No uniform technology standard for DNT signals has been finalised, so we do not currently respond to DNT signals.
12. DO CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?
In Short: Yes, if you are a resident of California, you are granted specific rights regarding access to your personal information.
California Civil Code Section 1798.83 ("Shine The Light" law) permits California residents to request, once a year and free of charge, information about categories of personal information we disclosed to third parties for direct marketing purposes.

We will use and retain the collected personal information as needed to provide the Services, in line with the GDPR storage limitation principle: personal data is kept for no longer than is necessary for the purposes for which it was created or obtained. For Category L specifically, see the retention period described in Section 4.
Will your information be shared with anyone else? We may disclose your personal information with our service providers pursuant to a written contract between us and each service provider. Omirakai Consulting has not disclosed, sold, or shared any personal information to third parties for a business or commercial purpose in the preceding twelve (12) months, and will not sell or share personal information in the future.
Your rights with respect to your personal data
- Right to request deletion of the data. You can ask for the deletion of your personal information, subject to certain exceptions provided by law.
- Right to be informed. You have a right to know what categories of personal information we collect and why, and whether we sell or share it.
- Right to Non-Discrimination. We will not discriminate against you if you exercise your privacy rights.
- Right to Limit Use and Disclosure of Sensitive Personal Information. Where you have provided sensitive personal information as described in Section 4, you may request that we limit its use to only what is necessary to provide coaching services.
